Privacy Policy and General Terms & Conditions of use of the WUnite mobile and web Application

The corporate purpose of WUnite is notably the creation, development and marketing, directly or indirectly, of secure applications for the web, mobiles, smartphones, tablets and derivatives, in particular in the field of communication, marketing, sponsorship, exchanges by any means between persons sharing a community of interests and aspirations, as well as all other commercial, administrative and/or IT services.

The purpose of these general terms and conditions of use (hereinafter referred to as the "T&C") is to determine the rules of use of the mobile and web application "WUnite" (hereinafter referred to as the "Application") (hereinafter referred to as the "WUnite").

By installing the Application on your terminal and/or accessing the Application, as a visitor and/or user, you unconditionally and unreservedly accept all of the Terms defined below. If you do not wish to accept these Terms, we ask you not to access the Application.

Any visit to and/or use of the Application must be made in accordance with these T&C.

Article 1. DEFINITIONS

Terms beginning with a capital letter within these T&C, whether used in the singular or plural, shall have the meaning given below:

"Application" means the software application "WUnite" published and provided by the company WUnite, giving access to the Services, which is available free of charge in Apple's "Apple Store" and Google's "Google Play Store" to be downloaded by the User on his Apple iOS and Android device. The Application also includes the Content, software, programs, tools (programming, navigation, etc.), databases, operating systems, documentation and all other elements and services that make it up, updates and new versions that may be brought to the Application by WUnite.

"Content" means, without this list being exhaustive, the structure of the Application, editorial content, drawings, illustrations, images, photographs, graphic charters, trademarks, logos, acronyms, corporate names, audiovisual works, multimedia works, visual content, audio and sound content, as well as any other content present within the Application and/or any other element composing the Application.

"Services" means the various functionalities and services offered by the Application.

"Site" refers to the official website of the WUnite, whose address is as follows: https://www.wunite.fr.

"User" or "You" refers to a natural person of full age or a minor who has obtained prior authorization from his/her parents or the person with parental authority, and who has downloaded the Application for his/her own needs, for strictly personal and non-commercial use, with no direct or indirect profit motive.

Article 2. PURPOSE OF THE APPLICATION

The purpose of the Application is to give you access to WUnite's suggestions. Several Services may be offered to the User, including:

Sharing   practical   information,   good   addresses,   events,   announcements, publications, giving opinions in accordance with these general terms of use.

This list is non-exhaustive and may be modified at any time by WUnite without WUnite being held liable in this respect by anyone.

The Application is reserved in the first instance for the community of women football players' wives from around the world whose identity will be verified and may subsequently be extended to other communities.

Article 3. INFORMATION PROVIDED BY THE USER - REGISTRATION

Each User guarantees to WUnite that the information he or she provides regarding his or her identity and contact details in the context of the Service is accurate, truthful, complete and up-to-date.

The User is solely responsible for the sincerity and accuracy of this information. The User undertakes to regularly update all information in order to preserve its accuracy.

WUnite cannot be held responsible for any errors, omissions or inaccuracies that may be found in the information provided by the User, nor for any prejudice that may result for other Users or third parties.

The registration procedure will be done through a Facebook connector for example. A User will be able to sponsor a new User by sending him/her the registration link knowing that all registrations will be subject to validation by the WUnite administrator. Once validated, a notification will be automatically sent to other people in the community to let them know about the newcomer.

Article 4. ACCESS TO THE APPLICATION

To access and use the Application, You must have a compatible phone or mobile device and access to the Internet.

The Application can be downloaded free of charge from the "Apple Store" and "Google Play Store" platforms.

Article 5. FINANCIAL TERMS AND CONDITIONS

The Application is offered free of charge to Users, excluding the cost of subscription with the mobile telephone operator, excluding the cost of connection and access to the Internet network, excluding any additional cost charged for data loading and excluding the cost of the WUnite subscription or itunes subscription.

Article 6. APPLICATION OF THE T&C

The T&C are applicable to any User of the Application and Services.

The User is invited to read carefully and at each visit the T&C, which are accessible by hyperlink on the home page of the Application and may be modified at any time and without notice by WUnite.

The Application may be updated on a regular basis. In this respect, any Application downloaded by a User is valid for a limited period of time, taking into account these updates, which must be downloaded imperatively, and any technical, legislative or regulatory developments, over which WUnite has no control.

Article 7. INTELLECTUAL PROPERTY OVER THE APPLICATION

WUnite is the exclusive owner of all intellectual property rights pertaining to the Application and its Content, subject to the rights of the companies licensed by WUnite, a list of which is available at https://www.wunite.fr/fr/mentions-legales.

None of the provisions of the T&C may be interpreted as an assignment, transfer, sale, concession, license, loan, lease, authorization to operate granted directly or indirectly by WUnite to the User on the Application, its Content and/or Services.

Article 8. LICENSE OF USE

WUnite grants the User a personal, non-exclusive, revocable, non-assignable, non- transferable, worldwide and free of charge right to use the Application, the Content and the Services solely for its own needs in the context of the use of the Application and the Services, to the exclusion of any other purpose.

It is strictly forbidden for the User to access and/or use the source codes of the Application and/or the software components of the Application.

The User does not acquire any intellectual property rights over the Application, the Content and/or the Services or any other rights other than those conferred hereunder.

This license does not confer any right of use to the User on the Content. The User therefore refrains from reproducing, representing, adapting and/or exploiting any of the Content.

The User expressly agrees that the use of the Application shall in no way infringe WUnite's rights, and in particular that such use shall not constitute an act of counterfeiting, unfair competition or parasitic use of the Content.

Article 9. OBLIGATIONS OF THE USER

The User expressly undertakes:

  • to download the Application on his equipment exclusively for personal and non- commercial use;
  • not to reproduce permanently or temporarily the Application, in whole or in part, by any means and in any form;
  • not to use any software or process designed to copy the Content without the prior written consent of WUnite.
  • not to adapt, modify, translate, transcribe, arrange, compile, decompile, assemble, disassemble, transcode, or reverse engineer all or any part of the Application, Services and/or Content;
  • not to export the Application, to merge all or part of the Application with other computer programs;
  • not to make short quotations, analyses and reproductions intended for press reviews as well as other uses expressly authorised by the law within the limits and conditions set by the latter and subject in particular to quoting the names of the authors and the editorial source
  • to expressly refrain from using software or devices likely to disrupt the proper functioning of the Application, nor to take any action likely to impose a disproportionate burden on WUnite's infrastructure;
  • not to extract or reuse, including for private purposes, without prior written authorization from WUnite, a substantial or non-substantial part of the content of the databases and archives constituted by the Application;
  • not to set up systems likely to hack the Application and/or the Content, in whole or in part, or likely to violate these T&C;
  • to inform WUnite as soon as it becomes aware of an act of piracy and in particular of any illicit or non-contractual use of the Application and/or the Content, regardless of the means of distribution;
  • not to sell, rent, sub-license or distribute in any way whatsoever the Application and/or Content to third parties.

The User guarantees that the content that he publishes within the Service does not contain anything that is contrary to the rights of third parties and the laws in force, and in particular the provisions relating to defamation, insult, privacy, image rights, breach of morality or counterfeiting.

The User thus guarantees WUnite against any possible recourse by a third party concerning the publication of said content within the Service.

The User has the right to access discussion areas where he or she can consult, in particular, the threads of discussion between Users, and exchange with the latter on a given issue.

The User undertakes not to disseminate private correspondence on the public discussion areas and must, to this end, use the private messaging service.

Any message posted by the User on the discussion areas is his sole responsibility.

The User may view messages from other Users on the public discussion areas and report them

WUnite reserves the right to block the User's access to all or part of the functionalities of the Service, temporarily or permanently, without prior notice or formality and without any compensation, in the event of failure by the User to comply with the T&C or any applicable legal or regulatory provision.

The WUnite administrator reserves the right to unsubscribe any User, to delete content, who contravenes the above commitments and provides information for advertising or profit-making purposes or who does not apply the network charter based on reliable information and respectful exchanges, as well as to initiate any legal proceedings in this respect.

Penalty clause: Any violation of one or more of the provisions contained in this Article shall result in the payment to WUnite of an indemnity of EUR 10,000.


Article 10. HYPERTEXT LINKS AND COOKIES

The site contains a number of hypertext links to other sites, set up with the authorisation of WUnite. However, WUnite is not able to verify the content of the sites thus visited, and therefore assumes no responsibility for this fact.

Browsing on the site is likely to cause the installation of cookie(s) on the user's computer. A cookie is a small file, which does not allow identification of the user, but which records information relating to the navigation of a computer on a site. The data obtained in this way is intended to facilitate subsequent navigation on the site, and is also intended to allow various measures of frequentation.

Refusal to install a cookie may make it impossible to access certain services. However, the user can configure his computer in the following way to refuse the installation of cookies: Under Internet Explorer Firefox, Chrome, and Safari: tab tool / internet options. Click on Privacy and choose Block all cookies. Validate on Ok.

Article 11. PROTECTION OF PERSONAL DATA

WUNITE as data controller implements a processing of personal data with the purpose of:

  • The monitoring of the user's needs by WUNITE determined following the sending of the contact form in accordance with the General Conditions of Use;
  • The establishment of statistics intended to measure and analyze the use of the Service;

The legal basis for the processing implemented is the consent of the data subjects, The data collected are essential for processing and are intended for the personnel authorised by the data controller as well as its possible subcontractors and partners.

WUNITE keeps the data only for the time necessary for the operations for which they were collected and in compliance with the legislation in force.

In this respect, the personal data of the persons concerned are kept for the duration of the contractual relationship increased by the periods of legal prescription.

The data of the persons prospected are kept for a period of 3 years from the last contact with the company.

Personal data is stored within the European Union.

Any person concerned by the processing has the right to question, access, rectify, delete data concerning him/her, to limit the processing, to have his/her data ported in certain cases, and to object to commercial prospecting in particular.

You can implement these rights with WUNITE.

Under Law No. 78-17 of January 6, 1978 called "Loi Informatique et Libertés" and the European Regulation 2016/679 of April 27, 2016 on the protection of individuals (RGPD) applicable since May 25, 2018 and in order to protect your personal data, we must be able to verify your identity in order to respond to your requests. To do this, you must enclose, in support of any request to exercise the rights mentioned above, a photocopy of an identity document issued by the Prefecture of Police of your place of residence. For any question related to your rights, WUNITE is at your disposal and answers at the email address sd@wunite.fr. Finally, you can address a complaint to the CNIL (French supervisory authority) if you feel that your rights are not respected. Article 12. AVAILABILITY OF THE APPLICATION

WUnite undertakes to make its best efforts to secure access, consultation and use of the Application Services. The Application is accessible 24 hours a day, 7 days a week, except in the event of force majeure or the occurrence of an event beyond the control of WUnite and subject to any breakdowns and maintenance interventions necessary for the proper functioning of the Application. Maintenance operations may be carried out without prior notice to Users.

Article 13. LIMITATION OF WARRANTY

Access to and use of the Application is at the User's own risk.

The Application and the software are provided "as is" and "as available" without any warranty whatsoever.

It is the responsibility of all Users to take all appropriate measures to protect their own data and/or software stored on their computer and telephone equipment against any attack.

The User declares that he/she is aware of and accepts the characteristics and limits of the Internet network and, in particular, the functional characteristics and technical performance of the Internet network; problems related to connection and/or access to the Internet network and/or websites; problems related to the availability and congestion of networks; problems related to the failure or saturation of networks ; problems related to transit time, access to online information, response times for displaying, consulting, querying or otherwise transferring data; risks of interruption; lack of protection of certain data against possible misappropriation or hacking; risks of contamination by possible viruses circulating on the said networks, etc. for which the WUnite cannot be held liable. WUnite cannot be held responsible for:

  • in case of defect, loss, delay or error in data transmission that are beyond its control;
  • for the sending of messages and/or data to a false, erroneous or incomplete address;
  • if data does not reach it, for whatever reason, or if the data it receives is illegible or impossible to process;
  • if the User is unable to access or use the Site, the Application and/or the Services for any reason whatsoever;
  • if, for any reason whatsoever, the connection should be interrupted. Furthermore, WUnite declines all liability in the event of misuse of the terminal and/or any incident related to the use of the terminal when using the Application. WUnite shall in no way be held liable for any damage, of any nature whatsoever, caused to Users, their terminals, their computer and telephone equipment and the data stored on them, nor for any consequences that may result from this on their personal, professional or commercial activity.

WUnite cannot be held liable for indirect damages resulting from the use of the Service, which are defined in a non-limitative manner as operating losses (turnover, income or profits), loss of opportunity, damage to image or reputation, commercial or economic prejudice.

Article 14. EVOLUTION OF THE TERMS AND CONDITIONS OF USE

The applicable T&C are those in force on the date of connection and use of the Application by the User.

WUnite reserves the right to modify, at any time, all or part of the provisions of the T&C without prior notice or prior information to Users in order to adapt them to changes in the Services, to technical, legal or jurisprudential developments or when setting up new services.

Any modifications that may be made by WUnite to the T&C will be brought to the attention of Users by simply putting them online. They are deemed to be accepted without reservation by any User who accesses the Application after said online posting. WUnite therefore invites all Users to regularly consult the T&C.

Any new Service incorporating new techniques or new features that improve the quality of existing Services will also be subject to these T&C, unless expressly provided otherwise.

Article 15. TERMINATION

WUnite may terminate your use of the Application at any time by giving you notice of termination.

Upon any termination, the rights and licenses granted to you will terminate and you must cease all use of the Application.

ARTICLE 17. APPLICABLE LAW

These T&C are subject to French law. In case of dispute the courts of Toulouse will be competent.

ARTICLE 18. DATA DELETION

A user can at any time decide to delete the data relating to her account. To do this, she can use the « Delete my account » feature from her account, which will delete her account and all associated publications and activities from the WUnite platform. It is also possible to make a written request to the administrator of WUnite at sd@wunite.fr
